This Privacy Policy (the “Privacy Policy”) discloses the privacy practices of NY to Stay, Inc. d/b/a NY Forever (“we”, “us” or “our”) with respect to our collection and use of Personal Information (defined below), on our online or mobile website, and any other media form or media channel related, linked or otherwise connected thereto (collectively, our “Site”). 

PLEASE READ THIS PRIVACY POLICY CAREFULLY. THIS PRIVACY POLICY CONSTITUTES A LEGALLY BINDING AGREEMENT BETWEEN YOU AND US THAT CONDITIONS YOUR USE OF THE SITE. BY USING, ACCESSING, OR DOWNLOADING A SITE, YOU SIGNIFY YOUR ACCEPTANCE OF THIS PRIVACY POLICY. 

  1. What Personal Information We Collect.


In order to better provide you with services, we may collect, process and store personal information about you.

When you engage in certain activities on the Site, we may ask you to provide certain information about yourself such as your first and last name, email address, phone number, postal address, gender and credit card and billing information when you subscribe for our listserv, purchase our merchandise, or donate to our organization (collectively, “Personal Information”). For example, we may share Personal Information when we believe in good faith that an applicable law requires it; at the request of law enforcement, judicial authorities (e.g. upon receipt of a court order or subpoena), appropriate governmental authorities; to detect and protect against fraud, or any technical or security vulnerabilities; to respond to an emergency; or otherwise to protect the rights, property, safety or security of third parties, visitors to our Site, our businesses, or the public. 

We may choose to buy or sell assets, and may share and/or transfer Personal Information in connection with the evaluation of and entry into such transactions. Also, if we (or our assets) are acquired, or if we go through some other change of control, Personal Information could be one of the assets transferred to or acquired by a third party.  However, we note that any entity acquiring our business or assets would have an obligation to use the Personal Information that comes with it strictly in accordance with this Privacy Policy. You acknowledge that such transfers may occur, and that any acquirer of us or our assets may continue to use your Personal Information only as set forth in this policy.

We will not sell or rent our donor and member lists for commercial purposes. However, we may, from time to time, make portions of our member lists available to other nonprofit organizations as a way to attract new donors. 

We may anonymize your Personal Information so that you are not identified as an individual, and we may use and disclose such information in a number of ways, including for research, analysis, and any other legally permissible purposes. Such information is not considered Personal Information.

4. We Do Not Sell Your Personal Information.

We do not disclose and have not disclosed your Personal Information to any other third parties for any purpose other than those described in this Privacy Policy or unless the law requires it.

We, also, will not sell and have not sold within the past 12 months your Personal Information without affirmative authorization.

5. Children.

We do not knowingly nor willingly collect, retain, use or disclose any information or documents from anyone under the age of 13. If you are under the age of 13, please do not use this Site and/or Services and do not provide us any Personal Information.

In the event that we discover that we have inadvertently collected Personal Information from a child under the age of 13 years, we will attempt to notify the child’s parent or guardian, and, if unsuccessful, we will delete the child’s Personal Information.  If you believe that we might have collected Personal Information from your child under the age of 13 years without consent, please contact us at hello@nyforever.nyc. 

6. Security of Personal Information.

We implement and maintain reasonable security appropriate to the nature of the Personal Information that we collect, use, retain, transfer or otherwise process. 

Though we are committed to developing, implementing, maintaining, monitoring and updating a reasonable information security program, unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. Data security incidents and breaches can occur due to vulnerabilities, criminal exploits or other factors that cannot reasonably be prevented. Accordingly, it cannot be assumed that the occurrence of any given incident or breach results from our failure to implement and maintain reasonable security. To the maximum extent allowed by applicable law, you agree and acknowledge that we shall not be liable or responsible if any information about you is intercepted, accessed, and/or used by an unintended recipient. Like many other websites, we may use “cookies” to collect information about your use of the Site when you use the Site in order to facilitate and customize your use of the Site. The cookies make your use of the Site easier, make the Site run more smoothly, and help us to maintain a secure Site. California Shine the Light.

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits California residents to annually request, free of charge, information about the Personal Information (if any) disclosed to third parties for direct marketing purposes in the preceding calendar year. We do not share your Personal Information with third parties for their own marketing purposes.

Our Site may, from time to time, contain links to and from websites or apps of our partner’s networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies or their practices. Please check these policies before you submit any personal information to the websites. We do not endorse or make any representations about third-party websites. Any Personal Information you choose to give to unrelated third parties is not covered by this Privacy Policy. 


10. Changes.

We reserve the right to revise this Privacy Policy at any time by amending this page and changes will be effective upon being posted unless we advise otherwise. If we make any material changes to this Privacy Policy we will notify you by means of a notice on our Site prior to the change becoming effective. By continuing to use the Site after changes are made to this Privacy Policy, you agree to such changes. We encourage you to check this page from time to time to take notice of any changes we make. If you do not accept the terms of this Privacy Policy, we ask that you exit our Site immediately.

The Privacy Policy published on our Site is kept up to date.
